Statements After a Car Accident That Could Hurt Your Claim

If you were injured in a car accident, the other parties and their insurance companies may try to minimize their financial liability by claiming that you are at fault. They may try to elicit a statement or admission that places the blame on you, or even ask you to sign a settlement.

While speaking with an attorney could help you avoid saying things that could hurt your claim, sometimes making a statement is unavoidable. If this is the case, keep the information factual and to the point, without speculating or implying fault.

What Not to Say After an Accident

Here’s how you can avoid hurting your claim.

Don’t Admit Fault

The aftermath of a car accident can be disorienting. It is not uncommon for victims to unwittingly claim fault without realizing it.

Even reactionary statements like “I didn’t see him” or “the roads are bad” can provide leverage for the other party to claim that you are responsible for the accident. Avoid any comments that imply fault, in order to protect your claim for injuries and losses.

Don’t Guess at the Cause of the Accident

Avoid guessing at what might have caused the accident, especially to other parties or their insurance companies. Such statements can be misconstrued by the opposing party as an admission of fault.

Rather than speculating, state simple facts without implying that you are responsible.

Don’t Apologize

Many people are conditioned to apologize for things that are not their fault, especially in distressing circumstances. What you may consider a kind gesture can be seen as an admission of fault and used to paint you as the guilty party.

In order to protect yourself, it is best to avoid saying “I’m sorry” or “I apologize” to anyone at the accident scene.

Don’t Say You Feel OK

Don’t Accept a Settlement Offer
